Wondering the e-signature legality in Malaysia?

Short answer: They are.

But there are a few things you need to get right to make sure yours is legally binding.

Here’s a quick rundown of how it works.

Two main laws govern the legality of e-signature in Malaysia: the Digital Signature Act 1997 (DSA) and the Electronic Commerce Act 2006 (ECA).

Here’s the difference:

Digital Signature Act 1997 (DSA)

The Digital Signature Act 1997 (DSA) is Malaysia’s way of making sure digital signatures are secure, reliable, and legally binding. It’s all about providing the legal framework to ensure that when you sign something digitally, it holds up in court and can’t be easily disputed.

So, how does it work? Well, to make your digital signature valid under the DSA 1997, it needs to come from a licensed Certification Authority (CA)—these are trusted entities that verify your identity and link it securely to your signed documents.

This is especially important for sensitive stuff like contracts, financial agreements, or any high-stakes documents where security and authenticity are crucial.

If your digital signature meets the DSA 1997 standards, it guarantees three key things:

That’s why digital signatures are perfect when you need top-notch security and trust.

But here's the catch: Only digital signatures verified by a licensed CA are enforceable under the DSA 1997. So, be sure to use a trusted provider to ensure everything stays legit

Electronic Commerce Act 2006 (ECA)

The ECA 2006 covers simpler e-signatures, like typing your name or clicking an “I agree” button. This type is fine for everyday agreements but doesn’t offer the same level of security as a digital signature.

For your e-signature in Malaysia to be valid under the ECA 2006, it has to meet a few conditions:

  • Choose a trusted e-signature service. There are plenty out there, so go with one that’s well-known and meets legal standards. For example, SigningCloud is a secure e-signature platform in Malaysia that’s specifically designed to comply with local laws.
  • Make sure it links the signature to the document. This is crucial for your e-signature to count as legally valid.
  • Ensure it identifies the signer and shows they approve the document. The signature should clearly indicate who signed and their agreement with the document’s contents.

Make sure it detects any changes after signing. If someone edits the document after you sign it, you want that to be noticeable—this keeps the integrity of your signature intact.

Digital Signature vs Electronic Signature

You have to know the difference between digital and electronic signatures to pick the right one. Both work for signing docs, but digital signatures are more secure and legally solid.

Digital Signatures

These use encryption to make the signature unique and impossible to forge. Great for serious agreements like major contracts. You’ll need a digital certificate from a licensed certification authority to verify it.

A digital signature is like your own super-secure digital “fingerprint” that proves who you are and makes sure the document hasn’t been messed with. When you sign, encryption creates a unique code that’s almost impossible to fake.

Just remember, for it to be legit, it needs a digital certificate from a licensed Certification Authority (CA). They’re the ones who verify your identity and link your signature to the document securely.

In Malaysia, these CAs follow strict regulations under the Digital Signature Act 1997, adding extra credibility to the process and making digital signatures ideal for high-stakes agreements, like contracts or financial transactions.

At SigningCloud we take security even further integrate with third party eKYC solution eKYC (electronic Know Your Customer). Before issuing a digital certificate, eKYC uses technology like facial recognition, government ID checks, and liveness detection to verify a signer’s identity digitally. This extra step prevents fraud and ensures that only verified individuals can sign.

By combining eKYC and CA verification, SigningCloud offers a complete, secure solution that makes your digital signatures both trustworthy and tamper-proof.

Electronic Signatures

Electronic signatures are the easy way to sign—like typing your name, clicking “I agree,” or using a scanned signature. They’re fast and work for regular stuff, but they don’t have the same security or verification as digital signatures. So, while they’re easy to use, they might not be enough for high-stakes or regulated documents.

The bottom line:

If you need top-tier security and protection, go with a digital signature. For everyday stuff where security isn’t a big deal, an electronic signature is all you need.

When to use e-Signatures

Summary: e-Signature legality in Malaysia

In short, remember this: when it’s a serious document where you might need proof of authenticity or extra protection, stick with a digital signature. If it’s a standard agreement, go with a basic e-signature and keep things simple.

Not sure? Check the e-signature guidelines—start with Malaysia’s Digital Signature Act or the MCMC site for the legal lowdown.
